What happens after you file a complaint with Policeabuse.com? If you have filed your complaint under our free service we will report your complaint to the police department on our letterhead free of charge. The police will receive your complaint and should contact you or our office within a few weeks of our report of a complaint to internal affairs. When the police receive your complaint an investigation will be started. The officers will be contacted by internal affairs or their supervisor. The assigned investigator representing the police department will question the officers and review their reports. Afterword, the police will contact you. They will ask you to come into the police station for an interview. The police will then question you about your allegations. At the conclusion of the interview with you and a review of the evidence collected from the officer’s interviews the police department will render a finding in one of the following categories: Guilty, Founded or Sustained -the charges are true or can be substantiated by the evidence Unfounded -the charges are completely without factual basis Not sustained -the officer may have done something that may appear to be misconduct, however based on policy or circumstances it does not rise to the level of a policy violation or violation of law. In other words the officer was acting lawfully. What are my chances of getting the officer found guilty? We would be dishonest if we told you that it is easy to prove a case of misconduct againt a police officer though we have done so many times. It is extraordinarily difficult to prove an officer guilty even if there is evidence. The police typically counter your evidence with their own. They will rely on policies procedures and police terminology that may not be familiar to you. If you sue the police they are automatically considered experts by virtue of their training and experience. Consequently, if you don't have a good attorney your chances are more remote. There are some things you can do to improve your chances for successfully pursuing a complaint. We suggest that you seek the advice of an attorney immediately. You also need an investigator and an expert witness. How can an investigator or expert witness help with my case? A trained investigator can locate evidence, interview witnesses and pick apart falsehoods in the police officer's testimony and reports. The investigator can also testify about his or her findings in a court of law. Many people think that they can collect their own evidence later to find out that it is useless when it is presented in court. You cannot collect your own evidence if you are involved in the case you are investigating. A good investigator can work under the direction of an attorney or expert witness to ferret out clues, locate witnesses and debunk false claims made by the police. Working with the investigator an expert witness can counter the police department's version of events with his own testimony and report. An expert can also direct you around various roadblocks the police shall construct to prevent the officers from being found guilty of misconduct. A good private investigator can collect evidence against the officers and interview witnesses. His testimony will support your case in future proceedings related to your complaint of misconduct.
